Georgia custody cases address two types of custody. First, physical custody concerns itself with deciding where and who the child will reside with upon an award of custody. Second, legal custody pertains to who will make legal cecisions conceringing the child on issues such as religion, choice of schools, etc . . .
With respect to physical and legal custody, it is possible that each type of custody may be awarded "jointly." For instance, if two parents were awarded "joint legal custody" of their child, then they would make the decisions together on issues such as religion, schooling, etc. . .
Joint physical custody in a Georgia child custody case usually occurs when splitting parents live very close to each other. Joint physical custody entails both parents sharing the right have custody of the child and no parent has what is called "visitation"rights. Joint physical custody entails a lot of give and take between parents that obviously have not been able to see eye to eye in the past and this type of custody should be entered into with extreme caution.
